Accidents happen all to often. What I'm more surprised of is why the hell he had access to the gun to begin with. If it was properly locked away with the ammo locked up elsewhere he would probably be playing with legos with his little brother.

The parent or legal guardian should face charges as well. It's as much his fault as it is the kid's
