Buying a jtag is NOT illegal. - Even though you are buying modified content, you cannot get into trouble because of this. However, if you're selling a jtag, there is a possibility that you will be caught. You are distributing modified content that MicroSoft does not agree with. You can sell regular xboxs on ebay, craigslist, etc. because you havn't done anything to it.

If it's not illegal then why don't they copyright it.

I don't think you understand what copyright is.
To copyright something it has to be yours.
And if it isn't, you need to consent with the owner.
Even though you're modifying the content, you'd still have to call up microsoft and ask for their permission. ;)
