Cool, let me know how you get on, they will inevitably try and fob you off but do not let them, and it is very important to keep your cool or they will hang up and you will have to do it all in writing which takes weeks. Also if they agree to anything with you, even if it is to get a manager to call you back, make sure you get it in writing (e-mail) from them.
Also, make sure you ask for the details of their legal department, address, telephone number etc (not doing this upon request would be yet another breach of the trading standards act)

When I called the person told me "He did not have the info" this was the supervisor (the person who "deals with escalations")
And when I made a post on xbox.com and quoted the Irish "Data Protection Act 1998" and people replied with quotes from the "Terms of use" and it had said something like this, but more technically "When you get banned your right to information is ceased" It was more less that., Id link you to that post but it was deleted.

Yea thats all anyone on Xbox.com does is send you links from the ToU which is pathetic.
