You guys do realize that these representatives do not have a working knowledge of the discretion to which bans are handed out, how they are handed out, and what the penalization is? They would simply be giving you there own guesses. The Enforcement Team does not release information to anyone, even other departments like live support, on how banning is done and what is being banned. I know this because I've happen to talk to a lot of chat representatives via phone. So everyone can stop speculating, or taking the speculation of others, and just wait it out and see what happens. If console bans were coming, they'd have already hit everybody they wanted to. Microsoft quick about minimizing damage. The reason I know is because when I got throw in a modded Call of Duty lobby, my console was banned within 24 hours, probably the first 8 hours.

You guys do realize that these online "reps" are people who sit behind a computer all day and jerk off while they talk to you. The second that rep saw "mod" she did what she was told and said that the person would get banned. Do you really think MS tells its employee that makes $5 an hour that they are planning a huge ban wave? Most likely no. This chick had no idea what she was talking about.
