Having a bat / weapon next to your bed is actually pre meditated and i know someone who got in a sticky situation with the law because of it
While this is technically true, no jury or judge would ever rule in the burglars favor. Not to mention in my state in the U.S, coming face to face with a burglar in your dwelling falls under the "stand your ground" law... not predmediated.
