Well they changed his accounts email you need to confirm the email change through the accounts original email soooo if xbox was not willing to return his account your most likely out of luck. I have been through the same thing.

Oh yeah just another thing I don't have the OG Xbox that the account was made on so I'm guessing I'm basically screwed right and less I can really steal that email

Doesn't matter if you made the account on the Xbox you need the access of the email the account is under or have your phone number verification step on it in order to get it baxk.

you dont have to use OG email to confirm. you add an email, confirm it, change it.

If they changed your account's security information, there's pretty much nothing that can be done.
I'm sure Xbox Live support doesn't believe in any stories that the account was hacked, which is probably why they keep denying any requests you make to get that account back. I'm sad to say but your chances of getting that account back are incredibly slim.
