This is another reason why you should stay clean and follow the terms of use on Xbox One. The Xbox support staff has been answering many questions on twitter about the console and features the system beholds.

UPDATE: Thanks Matt.

The Xbox Support Twitter now claims they were talking about the Xbox 360 and not the Xbox One, They are unable to comment on Xbox One ban policy at this time.

TeamArianaGrande So wait this is for the 360 and maybe the Xbox One or what?

Exactly what you said.
This is for the 360 for breaching ToU and only affects downloaded games.
This is not confirmed for the xbox one and if it was, it would probably only affect downloaded games (not physical copies) and only if they were to breach the ToU. (like for the 360)

Even though sometimes they make mistakes and ban someone by mistake? OK...

Ringer15 Totally out of context, the tweet above was referring to how you may forfeit your downloadable game titles on the 360 by breaking the ToU (Terms of Use).
Simply check out XboxSupport1's tweets where this is confirmed.

The twitter account goes on to say that this may not apply for xbox one as they do not currently know, they go on to say that this only applys to digital copies of games that you have purchased, if you were to be caught breaching the terms of use (modding/hacking etc).

Ted- I don't even get how this is legal but anyway

Because you agree to terms of service that legally say that they can do whatever they feel fit, like console ban you even thought you payed for the Xbox.
