I have been thinking and there are numerous reasons why they couldn't ban someone for not having the beta in their download history.
1. It could be your second account
2. For all they know my friend copied his onto memory unit and put on my xbox which does not in any way violate their code of conduct because it involves no form of hack/mod and is due to their own **** up.
3. Out of all the people playing the beta. What would lead them to investigating your account out of all of the people playing the beta.
The chances of getting banned for not having the beta in your download history seem miniscule.
But this does not meen to say they won't find out another way and ban you.
Just truing to rule that out for people who are panicking.

I played yesterday but i deleted today from my HDD because I didn't want to get ban

WTF why on earth would you delete it? Aslong as you don't play it, it won't make a difference as to whether it's on your hdd or not.

Well obviously you will never 100% not get banned.
People doing GPD mods on cod 5 are getting console banned so you can get banned for more or less any kind of mod now...

In MW2 its like a 100% non ban because everyboddy is modding or hacking..

Well No. If you are hosting lobbies then you will get banned.
As for the people who get in the lobbies, nothing will happen to them.

Look everyone, you 90% will not get banned if its in your download history. if it isnt 50% chance lol
