ho can it be in the download history

Its a BETA not a full game , therefore you will not get banned , Makers of Gears arent loosing money from people getting beta free if anything gaining money.

Is it good, first person?

Yeah i totally agree with this but the only flaw would be is that you do not have the license on your 360 for this ( therefor you would have to have it in your Download History )

So using another example just so your small brain can understand. If person A buys a DVD, then copies it and gives it to person B, is that piracy? Yes, yes it is.
