Take it to the police station. If after 30 days the owner doesn't claim it, then it is rightfully yours. Thats how the state law works.

It doesn't matter if there's a SIM Card if it's a smartphone. There's a mounted GPS on it that you can't disable unless if you disable the network which means you have to call in the company and you can't do that without verification.

If he reported it stolen then yes.
But if they don't report it stolen or call the phone within a few days you can keep it, by law.
