Call Of Duty Being Sued By Major Car Manufacturer

4
Call of Duty: WWII is undoubtedly a hit with fans, having cleared an impressive $500 million in sales over the weekend. That said, we actually learned that someone isn’t too crazy about the game’s release – the manufactures behind the popular Humvee line of vehicles.

The company recently filed a lawsuit against Activision, the publishers of Call of Duty: WWII, over the unauthorized use of their brand as a military vehicle within the game. AM General, the manufacturers in question, indicates that Activision has been using the Humvee trademark without permission in a number of Call of Duty games over the years, along with strategy guides and with select toys. In the lawsuit, the company accused the company of “taking advantage of its goodwill and reputation.”

Humvee vehicles have been appearing in Call of Duty games since Modern Warfare rolled around back in 2007. Since then, we’ve seen it in the Modern Warfare games, as well as Black Ops II and Ghosts. Now it’s apparently in WWII, and that’s where AM General seems to be drawing the line.

The company has made note that Call of Duty’s success has come “only at the expense of AM General and consumers who are deceived into believing that AM General licenses the games.”

That’s stretching it a bit right here. The reason we say that is because the Call of Duty games have been based more around single and multiplayer content, and not necessarily thriving because a Humvee is in the game. If the vehicle was really that big a selling point, then the Humvee driving game for PlayStation 2, released years ago, would’ve been a colossal hit. Alas, it wasn’t.

The company also noted that the company’s use of the Humvee is “a key selling feature of the game,” and that’s another statement that’s a bit far-fetched. Nowhere on the packaging does the game specifically call out Humvees, or have something saying Call of Duty: WWII Magical Humvee Edition.

Activision has yet to respond to the lawsuit, but it is a little bit on the ridiculous side. If the Humvee has been appearing in Call of Duty games for the last decade, why hasn’t the lawsuit been filed sooner? Are they just now catching on to the fact that, “Hey, there are Humvees in this game!”

We’ll see what comes of this suit in the next few months.

Call of Duty: WWII is available now for Xbox One, PlayStation 4 and PC.

Not really a ethical reason to sue somebody lmao, peolpe just find the slightest similarities and 2 seconds later hop onto the phone with their layer.

This is very desperate of them lol, how stupid.

Devastator4455 So if they use a jet the company who designs it can sue them too? BS, this is fair use. I don't see their trademarks on the jeeps. Gta has similar cars but un-branded. I don't care for Cod anymore but this should be thrown out and dismissed. Otherwise the cost of game making is going to skyrocket

Barely fair use in any way shape of form.

This has got to stop why would you even be mad? I would not file anything if someone used me .

Whether AM General knew or not, that's on Activision for not filing for it. If they didn't, then yes Activision, either on purpose or not, took advantage of using the vehicles. If AM General did know, then maybe they were lenient on it because, well it's cod, it gets people into war and I have no doubt people join military branches because of influences like cod, which means more vehicles and purchases from AM General.

So you could say it's jealousy, being pathetic and what not. But AM General has the rights to them and as cod gets bigger and still is not getting the license for it (which is a bit odd for the size Activision has become), you're damn sure any company would file a lawsuit.

Nice, just now filing for a lawsuit. Seems jealous of the success to me.

FourStar "Now it's apparently in WWII, and that's where AM General seems to be drawing the line."

Why would there be a Humvee in a World War 2 game? seeing as Humvee was founded in 1992 I think either they are lying about that part or the writer of this article is an idiot and has related this law suit to a game that it doesn't actually apply to.

If you go the humvee wikipedia site it clearly states Humvee was founded in 1984 so idk where you got 92 from.

My bad Hummer was founder in 1992, my point still stands though.
